Terms of service

Last updated: 28 October 2026

This English version is provided for convenience. If it differs from the French version, the French version prevails.

1. Scope

These terms govern all website design, redesign, search engine optimisation and maintenance services provided by Rayhan Balsiger, trading as WebyBoost, Chemin de Riamoz 8, 1296 Coppet. They form an integral part of every accepted quote. Any conflicting terms of the client apply only if accepted in writing.

2. Quotes and conclusion of the contract

Each service is subject to a detailed quote, valid for thirty days. The contract is concluded when the client accepts the quote in writing. The quote specifies the scope, the price, the delivery date and the payment terms.

3. Prices and payment

  • Prices are stated in Swiss francs. VAT not applicable, art. 10 para. 2 of the Swiss VAT Act (LTVA).
  • The quoted amount is fixed. Any work outside the agreed scope is covered by an amendment approved before it is carried out.
  • Unless stated otherwise, payment is made in three monthly instalments at no extra cost. A longer instalment plan is possible, with a surcharge stated in the quote.
  • Invoices are payable within thirty days. After that period, default interest of 5% per year is due automatically, in accordance with art. 104 of the Swiss Code of Obligations.

4. Delivery times

The delivery period runs from the client's written approval of the mockup, not from the order. It is stated in the quote.

If the deadline is missed for reasons attributable to the provider, the client receives a reduction of 10% of the invoice amount per working day of delay, capped at 30%. This reduction is the sole compensation for delay.

The delivery period is suspended for as long as the client has not provided the requested material or given an expected approval.

5. Client obligations

The client provides the necessary information, specific texts, images and access in good time. The client warrants that they hold the rights to the material supplied and indemnifies the provider against any third-party claim in this respect.

6. Revisions and approval

Revisions are unlimited during the design phase, until the mockup is approved. After launch, two rounds of feedback are included.

If the mockup does not suit the client, the client may withdraw from the project at that stage and receive a full refund of the sums paid.

7. Ownership and delivery

Where they are included in the chosen plan, the domain name and hosting are registered in the client's name, as is the site. With the Online presence plan, the domain name is not included and is paid for by the client. Once the price has been paid in full, the client has free use of the delivered site and its access credentials.

The provider retains ownership of its tools, methods and reusable components, as well as the right to cite the project as a reference, unless the client objects in writing.

8. Maintenance

The first two months after launch are free. After that, maintenance is billed monthly according to the chosen plan, with no minimum term and cancellable with one month's notice. It covers hosting, backups, updates, security monitoring and a volume of content changes specified in the pricing.

9. Liability

The provider exercises customary care in performing its services. Its liability is limited to the amount actually paid for the service concerned. Any liability for indirect damage, loss of revenue or loss of data is excluded to the extent permitted by Swiss law.

No particular position in search engine results is guaranteed, as these depend on third-party algorithms.

10. Termination

If the client cancels after the mockup has been approved, the work already carried out remains payable pro rata. The provider may suspend its services in the event of non-payment after a written reminder.

11. Governing law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-law rules. The exclusive place of jurisdiction is the provider's registered address in Coppet, canton of Vaud, subject to mandatory provisions.
